1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Haranzel Technologies Private Limited ("Haranzel," "we," "us," or "our") concerning your access to and use of the AI Forensix platform and related services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Services Description

AI Forensix provides:

• Real-time deepfake detection for images, videos, audio, and documents
• Blockchain-anchored authenticity certificates
• Forensic analysis and reporting tools
• API access for integration with third-party systems
• Enterprise-grade security and compliance features

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must create an account by providing accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Account Eligibility

You represent that:

• You are at least 18 years old
• You have the authority to enter into this agreement
• Your use complies with all applicable laws and regulations
• Information provided during registration is accurate and complete

3.3 Account Security

You must immediately notify us of any unauthorized use of your account. We are not liable for losses caused by unauthorized use of your account.

4. Acceptable Use

4.1 Permitted Use

You may use our services for lawful business purposes including fraud prevention, content verification, compliance, and security applications.

4.2 Prohibited Use

You agree NOT to:

• Use the service for unlawful purposes or to violate any laws
• Submit content you don't have rights to analyze
• Attempt to reverse engineer, decompile, or extract our algorithms
• Circumvent security measures or access controls
• Use automated tools to access the service (except via approved API)
• Interfere with or disrupt the service or servers
• Resell or redistribute the service without authorization
• Use the service to create competing products
• Submit malicious code or harmful content

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of content you submit for verification. By submitting content, you grant us a limited license to process it solely to provide our services. We do not claim ownership of your content.

5.2 Our Intellectual Property

All aspects of the AI Forensix platform - including software, algorithms, designs, trademarks, and documentation - are owned by Haranzel and protected by intellectual property laws. You may not copy, modify, or create derivative works without written permission.

5.3 Verification Results

Verification reports and authenticity certificates generated by our platform remain our property but are licensed to you for your legitimate business use in accordance with these Terms.

6. Fees and Payment

6.1 Pricing

Fees are specified in your subscription plan or service agreement. We reserve the right to modify pricing with 30 days' notice to existing customers.

6.2 Payment Terms

Payment is due according to your billing cycle (monthly, annual, or as specified). Late payments may result in service suspension. You are responsible for all applicable taxes.

6.3 Refunds

Refunds are provided at our discretion. Generally, fees are non-refundable except as required by law or specified in your service agreement.

7. Service Level and Availability

7.1 Uptime

We strive for 99.9% uptime (excluding scheduled maintenance). Enterprise customers receive specific SLA guarantees in their service agreements.

7.2 Modifications

We may modify, suspend, or discontinue features with reasonable notice. We are not liable for any modification, suspension, or discontinuation of the service.

8. Data and Privacy

Your use of our services is governed by our Privacy Policy. We process data in accordance with applicable data protection laws including GDPR, DPDP Act 2023, and other regulations. Please review our Privacy Policy for details.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Accuracy Disclaimer

While AI Forensix achieves high accuracy rates (96.8% in testing), no deepfake detection system is 100% accurate. Results should be used as part of a comprehensive fraud prevention strategy, not as the sole basis for decisions.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARANZEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Haranzel, its affiliates, and personnel from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any rights of others.

11. Term and Termination

11.1 Term

These Terms remain in effect while you use our services. Your subscription continues until canceled according to your plan terms.

11.2 Termination by You

You may terminate your account at any time through your account settings or by contacting support. Termination does not entitle you to refunds for unused subscription periods.

11.3 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any reason with 30 days' notice. Upon termination, your access ends immediately.

11.4 Effect of Termination

Upon termination, you must cease use of the service. Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. The courts of Mohali, Punjab shall have exclusive jurisdiction.

12.2 Dispute Resolution

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through arbitration in Mohali, Punjab under the Arbitration and Conciliation Act, 1996.

13. General Provisions

13.1 Modifications

We may modify these Terms at any time. Material changes will be notified via email or platform notification. Continued use after changes constitutes acceptance.

13.2 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

13.3 Entire Agreement

These Terms, together with our Privacy Policy and any service agreement, constitute the entire agreement between you and Haranzel regarding the service.

13.4 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect. The unenforceable provision will be modified to be enforceable while preserving intent.

13.5 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
